Prohibitionism in drug policy in Brazil
a reconstruction of the legislative process and the frameworks in the production of the 2006 Drug Law
Abstract
The purpose of this paper is to answer the following question: How the continuity of the predominance of the prohibitionist referential is expressed in the legislative process that produced the Drug Law (Law No. 11,343/06)? Thus, we seek to understand why, in a context of apparent opening of political opportunities for a change in the prohibitionist framework, such a change did not occur. The research shows that the proposal of the new law was an initiative of defenders of prohibitionism and, also, the absence of an anti-prohibitionist coalition in the Legislature disputing the elaboration of the new law
